1. Acceptance of Terms

By creating an account or using MentraHQ (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid subscribers.

2. Description of Service

MentraHQ is curriculum design software that generates module-based lesson plans, reading content, flashcards, quizzes, and assessments from documents uploaded by users. The Service is operated by MentraHQ and accessible at www.mentrahq.com.

3. Accounts and Eligibility

You must be at least 18 years old to create an account.
You are responsible for maintaining the security of your account.
One free curriculum generation is provided per account. Free accounts are limited to one user per email address.
MentraHQ reserves the right to suspend or terminate accounts that violate these terms.

4. Subscriptions and Billing

Free plan: One complete curriculum generation at no cost. No credit card required.
Pro plan: $39 USD per month, billed monthly. Includes unlimited curriculum generations.
Subscriptions renew automatically each month until cancelled.
You may cancel your subscription at any time. Access continues until the end of the current billing period. No refunds are issued for partial months.
Payments are processed by Stripe. MentraHQ does not store payment card details.
We reserve the right to change pricing with 30 days notice to active subscribers.

5. Your Content and Uploaded Documents

You retain ownership of all documents you upload.
By uploading a document, you represent that you have the right to use it and that doing so does not infringe any third-party intellectual property rights.
Do not upload documents containing personally identifiable information about students, minors, or third parties without proper authorization.
Uploaded documents are processed to generate curriculum content and are not permanently stored by MentraHQ.
You retain ownership of the curriculum content generated from your documents.

6. Acceptable Use

You agree not to use MentraHQ to:

Upload documents containing illegal, harmful, or abusive content
Generate curricula intended to mislead or deceive students or parents
Attempt to reverse-engineer, scrape, or abuse the Service
Share account credentials or circumvent free-plan limitations
Violate any applicable laws or regulations

7. Intellectual Property

The MentraHQ software, branding, interface, and website are owned by MentraHQ. You may not copy, reproduce, or distribute any part of the Service without written permission. Generated curriculum content belongs to you, the user.

8. Disclaimer of Warranties

MentraHQ is provided “as is” without warranties of any kind. We do not guarantee that generated curricula will meet any specific educational standard, be error-free, or be appropriate for every context. Review all generated content before use in a classroom or educational setting.

9. Limitation of Liability

To the fullest extent permitted by law, MentraHQ shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to active users by email. Continued use of the Service after changes constitutes acceptance of the updated terms.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
